Dear Visitor (hereinafter “you” or the “User”),

Nexify Limited, with registered office at No. 4 Harbourmaster Place, Eir Building, Custom House Dock, Dublin 1, Ireland, D01 K6X5, Tax/VAT No. IE3393380OH (hereinafter “we”, “us” or the “Company”), hereby wishes to inform the User about the use of cookies and other tracking technologies, as further specified from time to time (for example, pixels or SDKs; hereinafter, for convenience, cookies and the foregoing technologies are collectively referred to as “Cookies”), on the online properties on which this Cookie Notice is made available and, in particular, on the “Voyana” web app for mobile devices (hereinafter the “App” or “Voyana”).

Because Cookies are used on our properties for various purposes, this Notice explains why they are used.

Some Cookies (so-called first-party Cookies) are placed and controlled directly by the Company. Through these Cookies, the Company collects and processes certain personal data concerning you. In this Notice, including pursuant to Article 13 of EU Regulation 2016/679 of 27 April 2016 (hereinafter the “Regulation”) and Italian Legislative Decree 196/2003 (hereinafter the “Privacy Code” and, together with the Regulation, “Applicable Law”), we explain how we collect these data, the purposes for which we collect them and your rights.

Other Cookies (so-called third-party Cookies) are instead placed and controlled by third parties. This Notice contains links to notices published by those third parties, which we ask you to read carefully.

If you are not familiar with Cookies, please read this Notice and the Company’s general Privacy Notice, available at https://voyana.ai/legal-documents/privacy-policy/en.html, carefully so that you can make informed choices.

The Company attaches the utmost importance to its Users’ right to privacy and protection of personal data. For any information concerning this Privacy Notice, Users may contact the Company at any time in the following ways:

A. What Cookies are and what they are used for

Cookies are small text files that websites visited by the user send directly to the user’s device (usually to the browser), where they are stored and then sent back to the same sites the next time that user visits (so-called first-party Cookies). While browsing a website, the user’s device may also receive Cookies from different websites or web servers (so-called third-party Cookies); this happens because the website visited may contain elements such as images, maps, sounds or specific links to web pages on other domains that reside on servers other than the one hosting the requested page. In other words, these are Cookies set by a website other than the one currently being visited.

Cookies may last only for a single browser session (so-called session Cookies), in which case they are automatically deactivated when the user closes the browser; alternatively, they may have a predetermined expiry date, in which case they will remain stored and active on your hard drive until that date and will continue to collect information during different browser sessions (so-called persistent Cookies).

Cookies are used for various functions. Some are necessary to enable you to browse the App and use its features (technical Cookies). Others are used to obtain statistical information, whether aggregated or otherwise, on the number of users who access the App and how the App is used (monitoring or analytics Cookies).

B. Technical Cookies

Technical Cookies are used solely to enable you to browse the Company’s properties and use their features. They are always first-party Cookies because they are placed directly by us.

Some technical Cookies are essential to provide you with an optimal browsing experience or enable you to authenticate if you are a registered user, for example to access your reserved area (so-called navigation Cookies). Navigation Cookies are normally session Cookies and are therefore automatically deactivated when the browser is closed.

Other technical Cookies are useful in allowing you to save certain preferences (for example, language or country of origin) without having to set them again during subsequent visits (so-called functionality Cookies). For this reason, functionality Cookies are often persistent Cookies, as they remain stored on your computer even after the browser is closed, until their scheduled expiry date or until you decide to delete them.

The technical Cookies currently used on the App are listed in the table at the end of paragraph H.

As provided by Applicable Law, your prior consent is not required for the installation of technical Cookies. You can nevertheless manage them through the browser settings described in paragraph E, point 1. Blocking or deleting technical Cookies may impair access to and operation of all or part of the App.

C. Additional functionality Cookies

The Cookies described in this paragraph are used by the Company to facilitate use of the App’s features and improve your browsing experience in line with the service offered by the Company, or for purposes other than those set out in paragraph D below, such as protection against SPAM and fraudulent behaviour.

Some of the Cookies used by the Company are third-party Cookies, and your consent is requested for their use. Accordingly, when you access the App, a prominent banner is displayed informing you that these Cookies are used subject to your consent and that you may consent to their use by pressing the button provided on the banner.

The functionality Cookies currently used on the App are listed in the table at the end of paragraph H.

D. Monitoring or “analytics” Cookies

Analytics Cookies are used by the Company through Microsoft Clarity to collect statistical information on the number of users who access the Company’s services and how they use the App, including information about interactions with pages.

For this reason, when you access the App, a prominent banner is displayed informing you that third-party analytics Cookies are used subject to your consent and that you may consent to their use by pressing the button provided on the banner. If you give your consent to installation in this way, we will record your consent through a dedicated technical Cookie and/or by other means. This will prevent the Cookie banner from being shown to you during subsequent visits to the App. Please note that if you delete this technical Cookie from your browser using the methods set out in paragraph E, point 1 below, the record of your consent will be lost and the Cookie banner will therefore be displayed again during your next visit and/or access to the App.

You are free to withhold or withdraw your consent to analytics Cookies at any time without impairing access to the App or its content. You may use the banner, the “Cookie Preferences” command in the footer or the tools described in paragraph E below.

E. How to manage Cookies and object to their use

There are several ways to manage, disable and delete Cookies.

(1) Change your browser settings

Follow the instructions provided by the developer of the browser you use to learn how to manage, disable or delete Cookies:

Make your choices carefully. If you indiscriminately block all Cookies, including technical Cookies, you may no longer be able to use some or all of the App’s features. Deleting all Cookies may also remove preferences you have already set.

(2) Use the interactive tools provided by third parties

To disable third-party Cookies, consult the third-party notices identified in the Cookie Declaration and the tools they provide. Disabling non-essential Cookies does not affect use of the App’s essential features.

F. Processing methods and data-retention periods

The Company uses electronic means to process data collected through first-party Cookies and, within the limits of the choices expressed by the User, information made available by third-party Cookie providers. Technical providers may process data on the Company’s behalf as processors or, where provided for in their respective notices, as independent controllers. Appropriate technical and organisational measures are adopted to protect the data.

We inform you that, subject to the conditions and safeguards established by the Regulation, your data may be transferred to countries outside the European Economic Area which may not offer a level of privacy and personal-data protection comparable to that guaranteed by Italian and European privacy laws. However, where the Company acts as controller, we will attach the utmost importance to data security and will therefore manage such transfers with all due care and safeguards.

Specifically, for the provision of Microsoft Clarity, the Company’s provider, Microsoft Corporation, may transfer App Users’ personal data outside the EEA on the basis of the so-called Standard Contractual Clauses and, in particular, to the United States, adopting additional measures to ensure that the transfer takes place in accordance with the Regulation. Please note that some of the third parties identified in the tables in this Notice and/or in the banner may — as independent controllers of data collected through third-party Cookies — process personal data collected through installed Cookies from a location outside Europe. You should therefore read their notices listed above carefully for further details.

All processing is carried out according to procedures strictly connected with the relevant purposes and, in all cases, in a manner that ensures the security and confidentiality of the data.

Users’ personal data will be retained for the periods strictly necessary to fulfil the primary purposes set out in the table at the end of paragraph H, or otherwise for as long as necessary to protect the interests of both Users and the Company in civil proceedings.

G. Your rights

Users may exercise the rights guaranteed to them by Applicable Law or obtain further information or clarification concerning this Cookie Notice by contacting the Company in the ways described above.

Under Applicable Law, Users have:

the right to withdraw consent at any time where processing is based on their consent;

the right of access to personal data;

where applicable, the right to data portability (the right to receive all personal data concerning them in a structured, commonly used and machine-readable format), the right to restriction of personal-data processing, the right to rectification and the right to erasure (“right to be forgotten”);

the right to object:

on legitimate grounds, in whole or in part, to the processing of personal data concerning them, even where relevant to the purpose for which the data were collected;

where they consider that processing concerning them infringes the Regulation, the right to lodge a complaint with a Supervisory Authority (in the Member State in which they habitually reside or work, or in which the alleged infringement occurred). The Company is not responsible for keeping all links displayed in this Cookie Notice up to date. Accordingly, whenever a link is not working and/or current, Users acknowledge and accept that they must always refer to the document and/or section of the websites referenced by that link.
